did you not see the posts of people saying xbox live was not working?
edit: anyway does someone here work at gamestop? I got a Beats By Dre pill speaker and saw they sell and and wanted to return it (no receipt) and put it towards a wii u console, whats the return policy with no receipt for the holidays?

It's different per-store, just be nice to the person behind the counter, and as long as it's the same model (the bar-code rings up on their system), it should be okay. Make sure you tell them up front, that you're trading it toward CREDIT on a WiiU, so they know that you're not trying to get cash back for it. As long as it's unopened, you should be okay to sell it as-new. I'd try hitting up at least two stores in the area, so if the first will only do (used), try the 2nd store... but being unopened and wanting credit should be enough for most cashiers.

Every gamestop I have ever been to in any state I've lived in, as well. In fact, if they see it unopened, they won't take it even if you open it. They kick you out. It's their store policy (I've been told), not up for their discretion. They also won't take more than one copy of a game at the time.
Every electronics retailer I've seen won't take electronics without receipts anymore. Walmart wouldn't even take a landline phone back that was unopened in the box, because it was from the electronics department.

Yup, that's been my experience as well. Even at Target or Wal-Mart around here.
Edit: Straight from Gamestop's return policy:
"A receipt is required for all returns and exchanges."
