The new info on ms's policy was released a few days after I wrote this- log in more, dbag!!!!
But to clarify, ms will not charge a fee, that will be up to the publishers. The same people who brought us "the season pass."
And yes, a game can be given to one friend. Or shared between 10 family members. (Fees tba- check your manual. XP)
And durrrr Roswell aliens.

They need to put all of those copies of ET back in the landfill and bury the jackasses who dug them up with them! 
Seriously though, that game was the worst. The Raiders of the Lost Ark Atari game was almost as bad. Nobody I knew who had that game had a working copy. It always froze up seconds after putting it in. Yeah, the ET game was bad but at least it was playable in the sense that it worked more often than it didn't.

My aunt gave me her Atari and games when she got an nes and it had raiders of the lost ark with it. But it froze almost instantly so I thought I was missing some game secret! Hahahaha.
