hope this isn't true, but i found this on another site...hopefully just someone talking about something they dont know...
This is from another site:
"I just talked to MS when I noticed that my account had jumped a little over 5000MS. The rep told me that the promo points have been escalated and the matter will be resolved within 72 hours. I ask what they were doing if I had already spent them. The reps answer was that MS is planning on handling the matter is five phases.
1- If the points weren’t spent then they are just going to remove them from the accounts that got them.
2- If the points were spent leaving a zero or negative balance of points and there is a credit card on file, then they are going to bill for the points used.
3- If there is no credit card on file, they plan on sending out an E-mail “demanding” payment.
4- If there is no credit card on file and the “demand” for payment goes unanswered then they “may” subtract months of gold membership that equal the amount of points used.
5- If there is still a negative balance then they plan on banning the console and the account until it is no longer negative. This one she said at least three times."

Its not penalizing you. Its taking back something you shouldn't have had in the first place.
The long and short is that if you spent the points you got to "keep" them. Otherwise you gave back something that wasn't yours.
Edit: And I don't believe for a minute MS will be able to do crap to those who already spent the points. Its their mistake if the points are gone, they are gone.

Good point Melissa, I honestly hadn't thought of it that way. Either way whatever happens, I didn't get any points so I am glad to not be involved in any of it.

I'm more inclined to agree with Mini's version of things, anyone who got to spend their points should not be penalized nor do I think they'd have the balls to do so anyway.
We're not talking about a situation were any of us stole from them, they placed the points into our account on their own accord. It's not like any of us broke into X-box Live and unlocked the points ourselves, it was a mistake they made.
It's not stealing when the person who got "stolen" from placed what was taken into your hands and then 12 hours later realized they had given you too much and wanted it back. How were any of us to know what was going on, and lets face it how many people really gave a shit.
I'd chalk this up to something that won't happen again, and if you got to spend a little points on Microsoft's tab then good for you, I liken it to compensation for pushing that stupid ass Kinect down everyones throats.
