Yes, I've seen the ad somewhere else saying that at Walmart they will have plenty of copies to go around (which is a "NO DUH" moment, MS isn't pushing this to have short supply) and a lane devoted for Halo 3 purchases.
As others have said, if you want the legendary or collectors, pre-order. I'm just picking up the regular edition as with my previous CE's that stuff never gets used/looked at.

i had thought that the only copies bein givin out were reserved copies and that it was not actually coming out for any one who hadnt reserved it for 2 months.

I will be at my local gamestop around 11PM the night if release. Me and one of my friends from school/church will be waiting in line together to avoid any kid that decides to try and steal. Because this Legendary box is big and cost allot of $ so you can not be to safe.
